If the Seller of the house that you are purchasing are selling under a Grant of Probate, there are some things that you should bear in mind.

The Seller of the property will have very limited knowledge of the property and more often than not will not reply to any enquiries the solicitor will raise on your behalf. Therefore, they may not know if there have been any previous issues with flooding, subsidence, a new boiler installed etc. In the circumstances your solicitor should advise you at this point to carry out further in detail inspections and reports to ensure you are entirely happy with the property you are purchasing. You should also double check with your Solicitor and Estate Agent that the property is being sold with vacant possession, as some properties sold under a Grant of Probate can be ‘sold as seen’ it will therefore be down to the purchaser on completion to empty the property of its contents.
