In the event that you pass away without a surviving spouse/civil partner, your estate will typically be split equally between all of your children. However, the intestacy procedure is exceedingly long and can take up to 12-18 months from the date of the application to the date that it is all completed. Intestacy is a legal application, which can be long, complicated and time consuming compared with the more simplified procedure when a person passes away without a Will.
